Terms of Service

These Terms of Service govern your use of FlyQ websites, apps, and related services. Read them together with our Privacy Policy. If you do not agree, do not use FlyQ.

1. Acceptance

By accessing or using FlyQ websites, mobile experiences, accounts, waitlist sign-up, newsletters, booking or checkout flows, careers applications, or any related offerings (the Services), you agree to these Terms of Service. If you do not agree, stop using the Services.

2. Eligibility and authority

You must be old enough and have capacity to enter a binding contract under the laws that apply to you. If you use the Services for an organization, you represent that you have authority to accept these terms on its behalf.

3. Description of the Services

FlyQ provides same-day drone delivery and related logistics, account and onboarding features, waitlist and product-interest signup, optional email updates (including technology or product news where offered), advertising or coverage tools where we make them available, and hiring flows for careers. Coverage, routes, timing, pricing, and features can change. Beta or pilot areas may apply. We do not guarantee uninterrupted, error-free, or fully available operation.

4. Account security

You are responsible for activity under your account and for safeguarding credentials and devices. Tell us promptly at support@flyq.app if you believe someone accessed your account without permission.

5. Accurate information and deliveries

You agree to provide accurate pickup and delivery details, comply with weight and content rules we publish, and be available to receive shipments where required. Hazardous, illegal, or restricted items are prohibited. Operational limits (weather, airspace, regulation, safety) can delay or cancel flights.

6. User content and license

You keep your rights in content you submit (for example profile fields, addresses, application materials, or messages to us). You grant FlyQ a non-exclusive, worldwide license to host, store, reproduce, adapt, and display that content as needed to run, secure, analyze, and improve the Services. You confirm you have the rights to provide the content you upload or send.

7. Acceptable use

You will not misuse the Services: no unlawful activity, fraud, harassment, malware, unauthorized access, attempts to overload or scrape our systems without permission, circumvention of security, or infringement of others' rights. Reverse engineering is not allowed except where mandatory law says otherwise. We may suspend or terminate access for violations or risk to safety or compliance.

8. Bookings, fees, and payments

When you request quotes, book services, or buy paid plans, you agree to pay amounts shown at checkout and to provide accurate billing and contact data. Payments are processed by Stripe. Payment card data is collected and processed by Stripe under its terms and privacy policy, not stored on FlyQ servers in a way that replaces Stripe's role. Refunds, cancellations, chargebacks, and disputes follow the terms shown when you pay and applicable law. Nothing here limits non-waivable consumer rights.

9. Third-party services

The Services rely on providers such as Supabase (authentication, database, and file storage), Resend (transactional email such as sign-in links), Stripe (payments), Google (maps and address autocomplete), and Vercel (hosting and web analytics). Those services have their own terms and privacy notices. Your use of their features is also subject to their rules where applicable.

10. Intellectual property

FlyQ trademarks, logos, product names, and site content are owned by FlyQ or its licensors. Do not use them without prior written permission except as allowed by law. Feedback you give us may be used without restriction or payment to you.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided as is and as available. Drone operations depend on regulation, weather, airspace, equipment, and third parties. Site content is not aviation, legal, tax, or regulatory advice. We do not promise specific delivery outcomes except as we expressly state at booking.

12. Limitation of liability

To the fullest extent permitted by applicable law, FlyQ and its affiliates, directors, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from the Services. Our total aggregate liability for claims related to the Services is limited to the greater of (a) the fees you paid FlyQ in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars, except where law forbids such a cap (for example in cases of gross negligence or willful misconduct). Separate caps or rules may apply to specific shipments as stated in booking or order terms. We are not liable for delays or failures due to weather, airspace restrictions, regulation, third parties, or events outside our reasonable control.

13. Indemnity

You will defend and hold harmless FlyQ and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your content, your violation of these terms, or your violation of others' rights, to the extent permitted by law.

14. Privacy

Our Privacy Policy explains how we collect, use, and share personal data. It is part of these terms by reference. For privacy requests, contact privacy@flyq.app. For general help, contact support@flyq.app.

15. Careers and applications

If you apply for a role, you agree that application data (including optional résumé uploads) is handled as described in the Privacy Policy. You represent that your information is truthful and that submission of references or files does not violate anyone else's rights.

16. Governing law and disputes

These terms are governed by the laws of Mexico, without regard to conflict-of-law principles, except where mandatory protections in your country cannot be waived. For disputes arising from these terms or the Services, you and FlyQ agree to the courts of Mexico City, Mexico, subject to non-waivable rights you may have to sue in your home jurisdiction.

17. Changes, general terms, and language

We may update these terms by posting a new version and updating the date at the top. If a change is material, we will use reasonable efforts to notify you (for example by email or in-product notice). Continued use after the effective date can mean you accept the update. If any part of these terms is invalid, the rest remains in effect. FlyQ may assign these terms in connection with a merger, acquisition, or sale of assets. These terms are the entire agreement between you and FlyQ about the Services and replace earlier oral or written understandings on the same topic. We publish English and Spanish versions; if they differ, we will treat the version our legal team designates as controlling after a good-faith review, unless applicable law requires otherwise.
